In the Netherlands, employers and employees within a company hold primary responsibility for occupational health and safety (OSH). They must agree on working conditions and are supported by trade unions and the sectors trade association in drafting appropriate OSH measures. These working conditions are listed in the Working Conditions Act (Arbowet), which lays down the foundational OSH laws in the Netherlands. The Arbo-besluit (Working Conditions Decree) provides more detailed regulations under the Arbowet, outlining specific safety protocols for a wide range of sectors and categories of employees. The Arbocatalogus (OSH Catalogue) is an additional source listing a collection of measures and solutions for working conditions in the relevant industry. The Arbocatalogus also includes examples of ‘good practices’, offering practical methods to comply with the regulations. If an employer applies the measures from the Arbocatalogus, they can be confident that these actions meet the statutory requirements.
The Netherlands Labour Authority (NLA) is responsible for enforcing the legislation, and the Ministry of Social Affairs and Employment (SZW) allow companies greater leeway to customise the way they seek to promote good working conditions. The Ministry of SZW have published The Arbovisie 2040, which is a strategic vision outlining the governments goals and strategies for creating healthier and safer workplaces by 2040.
The Focal Point is the place where a great deal of knowledge, information and experience comes together. Representatives of employers' organisations and trades unions work together there to make information on safety and health at work coming from Europe accessible and comprehensible to all. The Dutch Focal Point is managed by TNO.
