Low value negotiated procurement: Further development of the Enforcement Capacity indicator of the OSH barometer (EUOSHA/2019/NE/D/SE/0090)

The European Agency for Safety and Health at Work (EU-OSHA) in close cooperation with DG Employment and the National Contact Points in Member States is developing a reliable and authoritative source of OSH information in the EU.

The information system consists of two elements: 1) a visualisation of a set of data and harmonised descriptions of  14 relevant indicators for OSH in the EU  (OSH Barometer), and 2) an analytical report every three or four years describing correlations, developments and trends and the context.

EU-OSHA would like to receive offers to review and to enhance and improve the quality and details of the “Enforcement Capacity” indicator of the OSH Barometer.

The “Enforcement Capacity” indicator should provide both quantitative and qualitative information about the national systems of labour inspectorates and other authorities that enforce OSH legislation. This covers structures but also actions such as OSH inspection, advice or awareness raising.

Quantitative data could include for example, evolution over time of inspector numbers per 100,000 workers, annual budgets dedicated to the different LI tasks (such as inspection, awareness raising, research, etc.) or evolution over time of administrative sanctions, etc.

Qualitative information about enforcement could also include information from governments and from third parties – e.g. research – on performance of enforcement, including benchmarking between such authorities.

Type of procedure

Low value negotiated procedure launched and managed by EU-OSHA. The Agency will sign the service contract directly with the successful tenderer following this low-value procurement process.

The maximum available total value for the contract will be EUR 59,000 (excluding VAT).

Main objectives / services provided for under the contract:

  • Identify all relevant data on the enforcement capacities overview (DG EMPL 2015, SLIC REPORTS; NIMP Reports, NERCLIS; ILO Country OSH profiles, IALI Publications on benchmarking and performance measurements of Labour inspections)
  • Analyse the sources and propose an alternative to the current descriptions
  • Explore the possibility of developing and including quantitative indicators   
  • Provide a draft version for three different countries
  • Provide a proposal for a matrix to compare countries.

Tenderers must comply with the following criteria:

  • The tenderer must prove its educational and professional qualifications in the field of OSH.
  • The tenderer must prove experience of working in the field of OSH in the last three years.
  • Tenderers must be able to demonstrate previous experience in research on OSH and enforcement.  with at least 2 projects delivered in the last 10 years.

Participation in this negotiated procedure for a low value contract will be open to natural and legal persons falling within the scope of the EU Treaties (this includes all economic operators registered in the European Union and all European Union citizens) and to all natural and legal persons in a third country which has a special agreement with the Union in the field of public procurement on the conditions laid down in that agreement.

For tenderers established in the United Kingdom

Please be aware that after the UK’s withdrawal from the EU, the rules of access to EU procurement procedures of economic operators established in third countries will apply to tenderers from the UK depending on the terms of any Withdrawal Agreement. In case such access is not provided by legal provisions in force, tenderers from the UK could be rejected from the procurement procedures.
