Directive 2009/105/EC - simple pressure vessels

Latest update: 04/10/2017
of the European Parliament and of the Council of 16 September 2009 relating to simple pressure vessels

The Directives aims at the harmonisation of the manufacturing of simple pressure vessels and their placing on the market. The Directive determines the essential requirements which simple pressure vessels must satisfy at the time of manufacture and before they are placed on the market. Member States shall not impede the placing on the market and the putting into service in their territory of vessels which satisfy the requirements of the Directive.

The Directive gives a definition on simple pressure vessels.

A simple pressure vessel is any welded vessel subjected to an internal gauge pressure greater than 0,5 bar which is intended to contain air or nitrogen and which is not intended to be fired. The Directive does not apply on fire extuinguishers, vessels for nuclear use or vessels in installations on board or in aircrafts. Vessels must satisfy the essential safety requirements set out in Annex I.

The Directive also regulates the certification procedure. The manufacturer must ensure that vessels meet the requirements in design and manufacturing standards. The Member States must approve a national inspection body that carries out the appropriate examinations and tests in order to check the conformity of the vessels. Only vessels that meet requirements shall carry the CE marking. The CE marking is specified in Annex II.

Member State are obliged to protect persons, animals and the property. They must ensure that vessels placed on the market meet the rquirements and take appropriate measures to withdraw unsafe products from the market or to prohibit or restrict their being placed on the market. In Annex III, the Directive sets out minimum criteria for the approval of national inspection bodies.

The Directive will be repealed by Directive 2014/29/EU as of 20 April 2016.
